Terms of Service

Welcome to DropTexts ("DropTexts," "we," "us," or "our"), a service operated by OV, LLC, a Missouri limited liability company. These Terms of Service ("Terms") govern your use of droptexts.com and any related SMS notification tools (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. OVERVIEW OF THE SERVICE

DropTexts allows creators and small businesses ("Creators") to collect phone numbers from interested shoppers ("Subscribers") and send SMS notifications about product releases or "drops." We do not sell goods, process payments, or manage transactions. We solely provide a messaging tool.

2. ELIGIBILITY

You must be at least 18 years old to use the Service. If you use the Service on behalf of a business, you confirm you have the authority to do so.

3. SMS CONSENT & MESSAGE TERMS

By submitting your phone number, you consent to receive automated text messages from the specific Creator you subscribed to.

  • Message frequency varies by Creator
  • Standard carrier rates may apply
  • You can opt out at any time by replying STOP
  • You can request assistance by replying HELP

DropTexts does not control or guarantee delivery timing or message content created by Creators.

4. CREATOR RESPONSIBILITIES

Creators are responsible for:

  • Only sending messages to Subscribers who have provided valid opt-in consent
  • Complying with all SMS, privacy, and marketing regulations
  • Accurately representing their products and drop schedules
  • Avoiding spam, abuse, and unlawful content

Creators may not use DropTexts for harassment, fraud, or prohibited marketing practices.

5. USER CONDUCT

You agree not to:

  • Interfere with or disrupt the Service
  • Access data or accounts you are not authorized to access
  • Use the Service in violation of any applicable laws

We reserve the right to suspend or terminate access for violations of these Terms.

6. DATA & PRIVACY

We collect only the information necessary to operate the Service, such as phone numbers and opt-in status. We do not sell personal data. Creators are independently responsible for their handling of Subscriber information. For additional details, please see our Privacy Policy.

7. SERVICE AVAILABILITY

We do not guarantee uptime or delivery of messages. SMS delivery depends on carriers and external systems outside our control. We may modify or discontinue the Service at any time.

8. DISCLAIMER OF WARRANTIES

The Service is provided "as is" without warranties of any kind, express or implied. OV, LLC does not guarantee accuracy, reliability, or availability.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • OV, LLC will not be liable for indirect, incidental, or consequential damages
  • OV, LLC's total liability will not exceed the amount you have paid to us in the 12 months prior to any claim (typically $0)

10. INDEMNIFICATION

You agree to indemnify and hold harmless OV, LLC from claims arising from your misuse of the Service, violation of these Terms, or violation of applicable laws.

11. GOVERNING LAW

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any disputes will be handled in state or federal courts located in Missouri.

12. CHANGES TO THESE TERMS

We may update these Terms from time to time. When changes occur, the "Effective Date" will be updated. Continued use of the Service constitutes acceptance of any revised Terms.
